These general terms and conditions apply to every order placed via the Koalasticks webshop.
2. Applicability
By placing an order on the Koalasticks website, the customer agrees to these general terms and conditions.
Deviations are only valid if confirmed in writing by Koalasticks.
The customer accepts that these terms and conditions apply to all items in the online assortment and every purchase placed online.
3. Product information
Koalasticks sells drumsticks and drum accessories.
We take the utmost care to ensure the accuracy of product descriptions, specifications, and images.
Variations in color, weight, wood grain, or finish may occur and do not constitute a defect.
As stated in the document:
The accompanying photo is for decorative purposes only and may contain elements or items that are not included in the price.
All products are offered while stocks last.
4. Prices
All prices are expressed in euros and include VAT and other taxes.
Shipping costs are listed separately during the ordering process.
Koalasticks reserves the right to change prices, but this does not affect orders that have already been confirmed.
5. Conclusion of the agreement
An order is final as soon as the customer receives an order confirmation by email.

If the customer purchases a product online, the purchase is concluded at the moment the customer has entered their order by clicking on the order button.
Koalasticks reserves the right to refuse an order in the event of clear errors (e.g. incorrect price display) or suspected misuse.
6. Payment
Payment is made via the payment methods offered on the webshop.
The order will only be processed after full payment.
The terms and conditions of the third party apply to payments made via external payment platforms.

The customer bears full responsibility and liability for incorrectly executed payments.
In the event of non-payment, Koalasticks reserves the right to cancel the order.
7. Delivery
7.1 Delivery time
The delivery and execution times are indicative and not binding.

Maximum statutory delivery time: 30 days, unless otherwise agreed.
If this timeframe is not feasible, the customer will be informed in good time and the order can be cancelled free of charge. Amounts already paid will be refunded within 30 days.
7.2 Delivery address
Incorrectly provided delivery addresses are the responsibility of the customer and may result in additional costs.
7.3 Partial deliveries
Koalasticks has the right to make partial deliveries.
7.4 Transfer of Risk
The risk passes to the customer upon physical receipt of the goods.
8. Right of withdrawal (14 days)
Consumers have the right to withdraw from the purchase within 14 days of receipt of the goods, without giving any reason.

When purchasing products, the consumer has the option to terminate the agreement without giving reasons for a period of 14 days.
Exceptions
No right of withdrawal for:
- Personalized or custom-made products
- Used, damaged, or incomplete items
- Items whose packaging has been opened
- Items that cannot be returned due to their nature
Return conditions
- Report return in writing via email
- Product unused, undamaged and in original packaging
- Customer bears return costs
- Koalasticks refunds within 14 days of correct receipt.
9. Warranty
Koalasticks respects the statutory 2-year warranty for consumers.
No guarantee for:
- Wear and tear from normal use
- Damage caused by misuse
- Wood breakage due to intensive playing

Defects caused by accidents, negligence, or misuse… are not covered by any warranty.
10. Liability
Koalasticks is not liable for indirect damage, consequential damage, or loss of profit.
Our liability remains limited to the amount of the order, except in the case of intent or gross negligence.
11. Force Majeure
Koalasticks is not liable for delays or shortcomings due to circumstances beyond our control, such as:
- Strikes
- Transportation problems
- Brand
- Natural disasters
- Supplier outages
As in the document:
Accidents, illness, fire, war, strikes, lockouts, riots, delays at suppliers…”
In such cases, the performance of the agreement is suspended.
12. Complaints procedure
Complaints must be reported in writing via email.
Koalasticks undertakes to respond within a reasonable time.
If a dispute cannot be resolved amicably, the customer may resort to the European ODR platform.
13. Privacy & cookies
Koalasticks processes personal data in accordance with GDPR legislation.
As in the document:

14. Applicable law and competent court
This agreement is governed by Belgian law.
Disputes fall under the jurisdiction of the courts of the district in which Koalasticks is established.
15. Varia
- Koalasticks may change these terms and conditions at any time.
- A purchase after a change implies acceptance of the new terms and conditions.
- Failure to enforce a provision does not constitute a waiver of rights.
- The invalidity of one provision does not affect the rest.
